PICO MAR – TERMS AND CONDITIONS OF BOOKING

Please read these Terms and Conditions carefully before making a reservation with Pico Mar. By confirming a booking on our website (www.picomar.com), you agree to be bound by the following terms.

  1. Booking and Payment

1.1 All bookings made through the Pico Mar website are subject to availability and confirmation.
1.2 A reservation is confirmed only once full or partial payment (as specified at checkout) has been successfully processed and a confirmation email has been issued.
1.3 The lead guest making the booking must be at least 21 years old and assumes responsibility for all other guests in the party.

  1. Cancellation and Refund Policy

2.1 Guests may cancel a reservation by contacting Pico Mar via email at [email protected]
2.2 Cancellations made at least 45 days prior to the scheduled arrival date will be eligible for a full refund of the amount paid (minus processing fees).
2.3 Cancellations made less than 45 days before arrival will not be eligible for a refund.
2.4 Refunds (if applicable) will be processed to the original payment method within 14 business days.
2.5 We strongly recommend guests obtain travel insurance to protect against unforeseen circumstances.

  1. Check-In / Check-Out

3.1 Check-in time is from 3pm on the day of arrival. Check-out time is by 10am on the day of departure.
3.2 Early check-in or late check-out may be available upon request and subject to additional fees.
3.3 Valid identification and the booking confirmation must be presented upon check-in.

  1. Guest Responsibilities

4.1 Guests must treat the property and all furnishings with care and respect.
4.2 Any damages, breakages, or losses caused by guests or their visitors must be reported immediately and may be charged to the guest’s credit card on file.
4.3 No parties or events are permitted unless pre-authorized by Pico Mar in writing.
4.4 The maximum occupancy per villa must not be exceeded.

  1. Damage and Liability Policy

5.1 Pico Mar shall not be liable for any injury, loss, damage, accident, or delay to persons or property during the stay, unless caused by our gross negligence or willful misconduct.
5.2 Guests are responsible for securing their personal belongings. Pico Mar is not liable for theft or loss.
5.3 Pico Mar reserves the right to cancel or modify bookings in the case of unforeseen circumstances, including force majeure events. A full refund will be provided in such cases.

5.4 By booking and staying at a property managed by Pico Mar Luxury Villas, you agree to be held financially responsible for any damage to the property or its contents caused by you or any members of your party during your stay.

5.5 A valid credit card must be provided at the time of booking. This card will be held on file and may be charged for the full cost of any damages, missing items, excessive cleaning required, or violations of house rules identified during or shortly after your stay.

5.6 We conduct a thorough inspection of the property after each guest’s departure. If damage or loss is discovered, we will notify you in writing (via email) within 24 hours of your checkout. You will be provided with a description of the issue, any supporting documentation (e.g., photos, invoices), and the amount that will be charged to your card on file.

5.7 We recommend that all guests have travel insurance that covers accidental damage and liability.

5.8 If the cost of damages exceeds the amount we are able to charge to your card, you will remain liable for the full cost and agree to pay any outstanding balance promptly upon request.

  1. Privacy

6.1 Pico Mar is committed to protecting your privacy. Personal data collected during the booking process will be handled in accordance with our Privacy Policy and used only for the purpose of managing your reservation and stay.
6.2 Your information will not be sold or shared with third parties without your consent, except as required by law.

7. Governing Law and Dispute Resolution

7.1 These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Costa Rica.
7.2 In the event of any dispute, controversy, or claim arising out of or relating to these Terms, the use of Pico Mar’s services, or the guest’s stay at a Pico Mar property, the parties agree to first attempt to resolve the matter amicably through good-faith negotiation and mediation.
7.3 If the dispute cannot be resolved through negotiation within 30 days, the parties agree to submit the matter to binding arbitration in accordance with the rules of the Centro de Conciliación y Arbitraje de la Cámara de Comercio de Costa Rica (Center for Conciliation and Arbitration of the Costa Rican Chamber of Commerce).
7.4 The arbitration shall be conducted in San José, Costa Rica, in the Spanish language, unless otherwise agreed by both parties. The arbitral award shall be final and binding.
7.5 Notwithstanding the foregoing, Pico Mar reserves the right to seek injunctive or equitable relief in the Costa Rican courts to protect its property or interests.

8. Concierge Services & Third-Party Access

8.1 To maintain the quality, safety, and integrity of our properties, Pico Mar works exclusively with a pre-approved network of professional service providers, including private chefs, wellness therapists, massage specialists, and other in-villa service professionals.
8.2 Guests wishing to book additional services such as private dining or spa treatments must do so through the Pico Mar concierge team.
8.3 For the safety of our properties and to ensure compliance with our service standards, unauthorized third-party providers (including external chefs, massage therapists, or entertainment providers) are not permitted entry to any Pico Mar property.
8.4 Failure to comply with this policy may result in the immediate termination of the booking without refund, and guests may be held liable for any resulting damage or security breaches.
